General Terms & Conditions / Rules

A. GENERAL TERMS AND CONDITIONS

Primebet International Limited (hereinafter "Primebet") is a duly registered company under the Laws of Malta, with Registration No. C 27556. Primebet’s registered and business office is located at No. 4, Valley Towers, Valley Road B'Kara BKR9022, Malta. Primebet is licensed and regulated by the Malta Gaming Authority – License No MGA/CL2/137/2000, on 11th May 2001.

Primebet pays taxes and betting duty in Malta and is subject to the control and regulations of the Malta Gaming Authority, the national authority of control for betting concessions licensing.

For customers registered with Primebet with an address in Germany the following applies: In accordance with German law (§ 17 II No 2 Rennwett- und Lotteriegesetz - Racing Betting and Lottery Act) a betting tax of 5% on the betting stake will be levied on each bet placed; Primebet will forward the betting tax paid by the customer directly to the competent German financial authority.

All betting transactions/contracts with an affiliated agency are received and processed solely in Malta, regardless of whether they were placed through a Call Centre, the website www.primebet.com (hereinafter "the Website" or “Primebet’s website”) or with an approved agent.

Primebet has the right to offer and accept bets on all events taking place worldwide that have an indefinite outcome.

For every placed and accepted bet, Primebet and the betting customer (hereinafter “the Customer”) are the sole parties to the contract (hereinafter “the Betting Contract”).

Place of jurisdiction is at the registered address of Primebet. The official language is English. The Laws of Malta apply. In the event of any discrepancies due to translations or interpretation, the English version of these General Terms and Conditions/Rules shall prevail.

The following version of the Terms and Conditions apply to all conclusions of bets and deals. Upon publication of these Terms and Conditions, all previous terms and conditions shall cease to be valid.

A1. Data Handling

Primebet handles all Customer accounts with strict confidentiality. Primebet will only make use of the data provided for the purpose of processing all betting transactions. The personal data will not be passed to third parties unless required by law or in the event of the Customer violating the General terms and conditions/rules.

The Customer hereby agrees that his/her personal data may be used within the context of a Betting Contract with Primebet, and is stored and processed within the context of the normal course of business.

The Customer hereby consents to the recording of all telephone calls placed to the Call Centre. The recorded messages will be used for the purposes of training, legal compliance, bet confirmation and quality purposes.

Primebet takes no responsibility for errors of inputting, transmission, and/or evaluation of betting data and/or results. In order to provide its services, Primebet may rely on third party service providers, from which Primebet is likewise excluded from any contractual responsibility. Therefore, in no circumstance, may claims be filed for incorrect, delayed, manipulated or mishandled data communication, or any other errors in the transmission of data. Primebet reserves the right to rectify obvious error in particular in the input of betting data and/or results or to declare placed bets void.

For Customers’ protection Primebet uses the most modern security technologies with 1024 bit encryption. All Customer data is fully protected during communication with our servers. The Customer can verify that the data transmission is secure by means of the status line on the lower edge of the browser when on our site and logged in. All secure connections between Primebet servers and the Customer computer are shown as https:\\www.primebet.com……….etc. Primebet pages are certified by Versign. This enables the Customer to ensure that the website being viewed is authentic and secure.

All secure pages (https:\\..) are checked by the customer browser as soon as opened. Expired or faulty certificates generate an error message.

A2. Account Terms

It may possible that accessing or betting through the Website and/or through a Call Center is forbidden to some or all residence of particular countries or restricted for some people in those countries.

Primebet’s website is not intended to be used by people in countries, wherein such activities are illegal for purposes of betting or for any other purposes.

Primebet is not obliged to inform, warn or educate customers of such restrictions in the Customer’s place of residence. The Website is not to be understood as an offer, advertisement or invitation on the part of Primebet for engaging in such activities as betting or use of other services in jurisdictions, wherein such activities are illegal.

Each Customer is responsible for informing themselves of the relevant laws in their place of residence.

Each Customer must be sure that they are acting within the legal limits of their jurisdiction when using the Website and/or when betting on the Website or through the Call Centre or any other media.

Primebet will not be held legally liable in any jurisdiction for violations of local law on the part of the Customer.

Primebet may at its sole discretion:

Primebet retains the right to make modifications to the current General terms and conditions/rules at any time. Any changes/modifications to the General Terms and Conditions/Rules will be displayed on the Website. Primebet will issue a notice on the website stating that a version of the Terms and Conditions is available. The Customer agrees to regularly inform him/herself of the latest version of the General Terms and Conditions/Rules and is responsible for adhering to the current General Terms and Conditions/Rules.

When a major change is carried to out the terms and conditions the player will be requested to read and accept the new version of the Terms and Conditions. Should the Player not agree with any of the new Terms issued by Primebet, he may ask for the closure of the account and for full refund of the funds held in the account. Once the player accepts the new Terms and Conditions these will come into effect and all other previous versions will cease to be valid.

Primebet reserves the right to exclude Customers from participating in any of its offers at its sole discretion.

Primebet retains the right to close a particular Customer account (hereinafter “Betting Account”) without providing a reason. In cases where there is a credit balance in the Betting Account the Customer will be sent a notification and will be paid that amount in accordance with the account withdrawal terms as specified in Clause 5 of the General Terms and Conditions/Rules.

In cases of fraud or attempted fraud in particular, the Customer will be excluded immediately from participating in the betting offers of Primebet.

Primebet reserves the right to close or exclude any Customer with false particulars from participating in all the betting offers. Primebet may also refuse to effect any payments of any winnings of such Customer Betting Accounts. On Primebet’s request, the Customer is obliged to produce an official document clearly showing the Customer identity (ID card, Passport, driving license).

Every Customer may only hold one Betting Account with Primebet. Customers already registered with Primebet cannot register as a new user with another name or with another email address. Primebet will delete any Betting Account which is registered with the same details of an existing Primebet Betting Account. If a Customer is found to violate this rule, Primebet is entitled to cancel any bets placed in that Betting Account.

Betting accounts are not transferrable and/or an item of sale and therefore cannot be transferred and/or sold to other customers.

Primebet does not allow the transfer of funds between accounts. Customers cannot instruct Primebet to transfer from one account to another any and/or all amounts held in that account.

Two or more people are not allowed to open a joint Betting Account. In the case of gaming teams, of which Primebet is not aware and which are generally not accepted, the Customer in whose name the Betting Account has been registered, is the only contract party with Primebet. No other user will be given Betting Account information or will be allowed to operate such Betting Account. In cases where there is doubt, Primebet retains the right to request proof of identity.

It is the responsibility of the Customer to provide immediate notification for every sum deposited by mistake into his Betting Account. All winnings received in error are invalid and must be immediately paid back to Primebet, regardless of the manner in which they were received.

Where Primebet has any suspicion of manipulations or fraud, and in case of any violation of these General Terms and Conditions/Rules, in particular multiple users operating one joint Betting Account or users opening multiple Betting Accounts, Primebet may exclude the respective Customers from placing further bets and from participating in any other offers. In such cases Primebet will pay the user any credit balance in the respective Betting Account after deduction of an administrative fee of 10% of the deposited amount, provided that all monies received in this Betting Account were acquired in a lawful manner.

Where fraud is suspected Primebet reserves the right to report such accounts to the relevant authorities.

Betting Accounts opened with Primebet are for the sole purpose of betting.

A3. Registration of a betting account

Upon registering a Betting Account, the Customer agrees that:

Should a Betting Account be opened and used, and later be found to be in breach of any condition outlined in section 3 or any other condition, Primebet or a Maltese legal institution may confiscate the money from this Betting Account.

DISCLAIMER

For legal reasons we are not able to accept bets if the user is located in the above mentioned countries. In such cases, we must kindly ask users not to place bets. By placing a bet, the user confirms that he/she is not situated in any of the above mentioned countries at the time of placing a bet. Registrations from users from the above mentioned countries are currently not possible. In order to register a Betting Account, the Customer must fill in the registration form found on the Website. The Customer is to choose the "Register" link from the home page, in order to arrive at the registration site. All necessary information must be filled in correctly and completely. The General Terms and Conditions/Rules must be read and accepted, in order to proceed with the registration.

The following details must be filled in:

First Name, Surname, valid e-mail address, valid telephone number, full Address and date of birth.

The customer must also confirm that he has read and accepted the current terms and conditions/rules which will govern the relationship between the Customer and Primebet.

After the registration is accepted, a Betting Account number (hereinafter “Betting Account Number”) and a personal identification number (hereinafter “PIN”) for the Customer will appear on the screen.

Primebet reserves the right to close or exclude any Customer with false particulars from participating in all the betting offers. Primebet will immediately block/close any account with missing or false particulars. All bets in such accounts will be declared void and funds held in the account may be confiscated.

The Customer is responsible for maintaining the secrecy of his Betting Account Number and his PIN. Primebet takes no responsibility for bets made by a third party, to whom this data has become known. It is the responsibility of the Customer to inform Primebet immediately when he/she becomes aware of such a fact. In such cases Primebet will provide the Customer with a new PIN.

If and when any of the personal data used on registration are changed, Primebet is to be notified immediately either by modifying the data directly on the Website or by sending an email to security@primebet.com.

All Customers can choose to be excluded from all offers or betting with Primebet.

Customers can block their Betting Account with Primebet by informing Primebet immediately when he/she has taken such a decision. An e-mail is to be sent to office@primebet.com informing Primebet of the request for blocking. The Customer has to define the blockage period, example 1 week, 1 month, 1 year or unlimited. Once the blockage period has elapsed the Customer can then use his Betting Account again. The Customer cannot ask Primebet to re-activate his Betting Account during the blockage period. If the Customer instructs Primebet to block his/her Betting Account for an unlimited period the Betting Account will be blocked for a minimum period of six months. It is at Primebet’s sole discretion whether this Betting Account will be opened again or not. During the blockage period the Customer may not take part in any of Primebet’s offer. The Customer cannot open another Betting Account with different details during the blockage period. If this occurs Primebet will block these Betting Accounts for the same period. Any bets placed in such Betting Accounts will be voided. The customer may however, request withdrawal of all funds held in the account by contacting Primebet’s Customer Support.

A4. Account Deposits

The Customer may at any time freely use the balance available in his/her Primebet Betting Account which does not include any stakes for open Betting Contracts. Winnings will be credited directly to the Primebet Betting Account and can also be utilised for further betting. Upon Customer’s request winnings credited may also be remitted, in whole or in part to a bank account indicated by the Customer. (in accordance with the withdrawal regulations as set in these General Terms and Conditions/Rules).

A Customer may choose one of the following deposit methods:

When a Customer pays in via bank transfer it is the responsibility of the Customer to ensure that the Primebet bank account is quoted on the deposit made at his/her bank. All deposits received from Customers without the relevant Primebet Betting Account Number indicated will not be credited until it is proven that these funds were deposited in Primebet’s bank account in relation to a particular Customer.

Also it is not permitted to deposit funds via a third party bank account to the Primebet bank account. All monies received via bank transfer must be received from the same identical bank account holder name as is registered with Primebet.

When paying by bank transfer, the Customer accepts the usual 2-3 days processing period, before the money is credited to his/her Primebet Betting Account. Upon request the Customer may be notified by either telephone or e-mail (according to his/her choice), as soon as the transfer has been successfully completed.

Any bank processing fees are to be paid by the customer.

Credit Card

Minimum deposit by Credit card € 10.

The processing of the credit card will be carried out immediately upon entry of the card number, CVV2/CVC2 (sometimes referred to as security code) and expiry date of the credit card.

The credit card used to deposit funds in the Primebet bank account must be registered in the same name of the holder of the Primebet Betting Account.

Credit card deposits may at times be fully or partially declined due to certain security systems which are run in connection with our reputable payment gateway or financial institution. These security measures may decline legitimate credit cards, which nevertheless at that particular time would not be able to be processed. Primebet’s staff do not have any control on the system and therefore cannot provide the Customer with reasons as to why these transactions are being declined at that time.

Due to the obligation that Primebet has to fight credit card fraud, Primebet reserves the right to verify a Customer’s credit card deposit and may also ask for full identification documents and a copy of the credit card used at deposit stage. The Customer understands that this may cause slight delays. Customers should black out the CVV2/CVC2 as well as the main card number except for the first and the last four digits before sending the copy of the card

Moneybookers

Minimum deposit by Moneybookers € 10

Moneybookers is an e-payment wallet solution that enables the Customer to transfer funds into a 'virtual' Moneybookers account using ELV, Giropay and via local bank transfer or cheque in over 30 countries, quickly and efficiently. Once the funds are in the Moneybookers account they can then be transferred into the Customer’s Betting Account.

All deposits via Moneybookers have to be effected from the deposit page on Primebet’s website. Once all details are filled the Website will route the Customer to the Moneybookers deposit/login page.

It is imperative that the Customer registers the same email address used with Primebet as the email registered with Moneybookers.

Paysafecard

Minimum deposit by Paysafecard € 10

Paysafe is the easiest and fastest way to pay online without using a credit or debit card.

The Customer needs to input the necessary details into the boxes provided in the deposit pages on Primebet’s website.

All deposits effected by Paysafecard are charged a fee of 5.5% of the deposit amount.

Any fees incurred by Primebet due to incorrect details provided by the Customer when effecting payment using any of the above methods are to be borne by the Customer.

If the Customer decides to use electronic payment, he/she agrees to refrain from any revocation or similar actions, as long as the transfer is carried out in accordance with the applicable regulations. Otherwise the internationally acknowledged regulations and laws regarding electronic payment will apply.

All deposits made in the Primebet Betting Accounts are to be used solely for betting purposes. If deposits are made and are not used for betting, Primebet - particularly in the case where abuse is suspected – reserves the right to cancel the respective deposits in part or in full. For all such transactions a processing fee of 7% of the deposit amount, but not more than €15 and not less than €5, will be charged against the balance that was not used for betting. Such Betting Accounts will be disabled as soon as the necessary transfers have been effected following the normal procedure as outlined throughout the General Terms and Conditions/Rules.

Should any funds be credited to a Customer`s Betting Account in error, the Customer is to inform Primebet immediately when he/she becomes aware of the error. Any winnings that are the result of bets placed using such funds will be invalidated, irrespective of the delay in notification of such errors. Incorrect amounts which are credited to a Customer`s Betting Account are to be paid back to Primebet immediately. Furthermore, Primebet reserves the right to block any other account found to have been opened by a person who had availed himself of erroneously credited funds and stopped using the original account.

Any claims or disputes to monies credited into the Betting Account must be lodged within 30 days to our Customer Support in writing. An email is considered to be a valid request. Any claims received after 30 days will not be accepted.

If an account does not record any log in or log out for a continuous period of twelve (12) months or more (the “Grace Period”), the account shall be deemed to be inactive. Once an account has been deemed inactive, Primebet is entitled to charge that account a maintenance fee (the “Inactivity”). The Inactive Account Fee shall be deducted from the credit account balance as from the first day immediately following the last day of the Grace Period, and shall continue to be so charged every thirty (30) days thereafter. The Inactive Account fee shall be of five Euros (€5.00) per every 30 days of inactivity and shall be subject to change from time to time in accordance with the Laws of Malta. Primebet will endeavor to inform the customer 30 days prior to commencement of charges and also giving the option to customer to withdrawal funds not to incur the fees.

If an account remains inactive for a period of 30 months (or as per current regulations) or more, Primebet is obliged to report such accounts to the Malta Gaming Authority, in accordance with the Remote Gaming Regulations. It is the responsibility of the account holder to keep up to date with the current regulations.

At any point the customer can request the remaining funds in the account. The funds will be considered of the customer at all times. Should the customer request the balance in the inactive account, Primebet will affect the payment once the account holder is verified as per normal Primebet procedure. Primebet will attempt to transfer such funds to the Player before reporting to the authority.

All transactions are checked to prevent moneylaudering.

A5. Account Withdrawal

The following applies for all withdrawal methods offered by Primebet

The Customer is entitled at any time to demand full or part payment of any credit balance held in his/her Betting Account, provided that all deposits made into the same Betting Account have been cleared. The Customer may request a withdrawal by contacting Primebet via the withdrawal page on the website or via an email to office@primebet.com submitting the full details of the Customer’s bank account.

A Customer may choose one of the following withdrawal methods but Primebet retains the right to choose at its sole discretion how to effect payment to the Customer:

Withdrawal by bank transfer

The Customer may request a withdrawal by completing the form on the Website in the withdrawal page. The Customer needs to provide Primebet with the necessary details to enable Primebet to effect payment. If the Customer requests a withdrawal and is not a resident in Germany or does not hold a bank account with a German Bank, the Customer must provide a valid IBAN and Swift code. Any charges charged by the receiving bank are to be borne by the Customer. The Customer agrees to disclose his/her bank details. The Customer also agrees that this information may be used by Primebet for the purpose of transferring money as requested by himself/herself via the Website or by email.

For security reasons, Primebet reserves the right to restrict payments until a clear copy of a valid Passport or Personal Identification Card and/or any other documents as required are received.

When a withdrawal is requested, Primebet reserves the right to retain payments until the final verification on any Credit Card used by this account has been effected.

Withdrawal by Moneybookers

The Customer may request a withdrawal of all or part of his credit balance via Moneybookers through the withdrawal page on Primebet’s website. The Customer needs to fill in the necessary form and the withdrawal will be processed as soon as all the necessary security checks are affected.

No withdrawal will be paid out unless the e-mail registered with Moneybookers is the same as the one registered with Primebet.

Primebet cannot be held responsible for the misuse of a Betting Account by any unauthorized person, if the Betting Account Number and/or the PIN were given out to a third party. The Customer is solely responsible for the secrecy of his/her Betting Account Number and PIN. All transactions, deposits and payouts are registered solely in the Customer's name.

Primebet reserves the right to retain withdrawal requests from Betting Accounts in which the initial deposit was placed by Credit Card for a maximum of 120 days. This precautionary measure is required to ensure that the funds are cleared by the financial institution.

Withdrawal requests of deposited amounts in the Customer’s Betting Account that were not used in betting transactions may only be accepted after 120 days from the original deposit.

In the case of deposits that were made and not used for betting, Primebet - particularly in the case where abuse is suspected – reserves the right to cancel the respective deposit in part or in full. For all such transactions a processing fee of 7% (not less than €5 and not exceeding €15) of the deposit amount will be charged against the balance that was not used for betting. Such Betting Accounts will be blocked as soon as the necessary transfers have been effected following the normal procedure as outlined throughout the General Terms and Conditions/Rules.

Primebet is not and will not act as a financial institution. All fund received at Primebet are to be used for the services offered by Primebet ie betting. The customer will not expect interest to be paid on any deposits made in the betting account whether use for betting purposes or not.

Primebet reserves the right to effect payments of winnings to the method it deems more suitable if the initial deposit was effected by credit card. In such cases the Customer will be notified as to how the money will be sent back to him/her. In such cases Primebet normally effects payment back to the original card that was used for the initial deposit as is required by local regulation. In such cases where Primebet does not have the necessary security documents to validate customers or where Primebet is informed that the card used in the initial deposit has been lost or stolen Primebet reserves the right to effect payment after 120 days from the initial deposit date.

Any withdrawal exceeding Euro 2300 will only be paid out once all verification/identification documents have been sent and checked by Primebet as stipulated in the Remote Gaming regulations (Part VIII 36.)

Any claims or disputes regarding withdrawals must be lodged within 30 days. Any claims received after 30 days may not be accepted.

All transactions are checked to prevent money laundering.

A6. Placing Bets

A bet can only be placed by a registered Customer of Primebet with sufficient available funds in the account to cover the bet amount. The only two parties taking part in the Betting Contract are Primebet and the Customer.

A bet is only valid once the customer has confirmed the bet and Primebet have confirmed the acceptance of that bet to the customer. Once a bet is accepted a unique betting slip number is issued by Primebet and this is made visible for the customer either on the confirm bet page or in the account statement. A Bet cannot be changed or cancelled unless declared as an invalidated bet.

All Valid Bets will be automatically debited to the customers Primebet account.

All bets are accepted at the sole discretion of Primebet. Primebet also reserves the right to limit bet amounts.

Every bet the Customer confirms and places, he/she is automatically accepting that the current version of the General Terms and Conditions/Rules remain valid and are applicable to all the Customer transactions.

A bet will only be accepted by Primebet, if the entire bet amount is available as a credit on the Customer’s account. If the amount is not covered entirely, individual bets (in the order given by the Customer), will only be accepted up until there are enough funds in the Customer’s account.

If a bet has been accepted despite insufficient funds, example due to a technical error, the Valid Bet will be invalidated whether the Customer wins or loses. Primebet can consider accepting the bet for the amount available in the customer’s account at the time the bet was originally placed. Primebet cannot be held liable for compensation.

Bets must be received/placed via a channel which is approved by Primebet. No bets may be sent to us via Post, Fax, or e-mail. Bets received in such a manner will not be accepted, regardless of whether the Customer wins or loses. Primebet are not obliged to inform customers who attempt to place bets in such a manner that their bets have not been accepted.

A7. Account Information

The Customer can ask for a Primebet account statement at any time for his/her own records.

A customer can view/print his/her betting activity from our Website. Once logged in and by clicking on the statement tab the customer can choose to see the activity on that Betting Account for various periods for a maximum period of 30 days.

Upon request Primebet will send account statement by post, fax or via e-mail for betting or account activity older than 30 days. Repeated requests may incur a fee.

Customer complaints regarding any betting activity or account transaction can only be accepted within 30 days from the date of the activity and/or transaction.

A8. Customer Complaints

Further to the above complaint procedures the customer is also able to escalate complaints of a serious nature to the Malta Gaming Authority. Such complaints should be sent to support.mga@mga.org.mt with details of the customer account and the issue being raised.

A9. Betting Information

Additional information about betting events (tables, statistics, etc.) is an optional service offered by Primebet to its Customers. Therefore, Primebet assumes no responsibility for the additional information contained therein, or for its completeness or accuracy. Therefore, any errors found in such information has no influence on the validity of any placed bet. It is assumed that the Customer has sufficiently informed himself about the event on which he is betting.

All information found on Primebet website or in any other Primebet media, cannot be guaranteed for correctness. Example: start times are especially subject to change without prior knowledge of Primebet or Primebet may have received incorrect data from third parties.

The official betting/racing reports are to be referred to as explained above in these General Terms and Conditions/Rules.

A10. Data Protection and Privacy Policy

Protecting your privacy is important to Primebet International Ltd (“the Company”). We have notified under the Data Protection Act (Chapter 440 of the Laws of Malta). We strive to keep your personal information protected. Please take a moment to read the following policy to learn how we handle your personal information, as your use of our services will indicate your acceptance of its content.

Purpose for the collection of personal information

We collect and use your personal information to satisfy legal and regulatory requirements, historical and statistical purposes, for security and control, to provide you with our services and to make more of such services available to you in the future. From time to time, we may also use your personal information to contact you by mail, email, telephone or mobile phone to introduce you to our products or any events, activities, projects, plans, developments, undertakings and special offers taking place, being promoted or supported by the Company.

By supplying us with your information you confirm that you do not consider use of your information in accordance with this Privacy Policy to be a breach of your rights under the Data Protection Act (Chapter 440 of the Laws of Malta).

We encourage you to contact us at any time and remind you of your right to opt out from receiving any promotional or marketing materials from us at any time.

Disclosure of personal information to third parties

As a policy the Company will not disclose any personal information to anyone other than those employees that need access to your data to provide you with a service.

We may be required by law or legal process to disclose your personal information to authorities such as the local Malta Gaming Authority.

Protection of your personal information

The Company safeguards the security of the data you send us with physical, electronic, and managerial procedures. Please note that we cannot guarantee that any data transmission over the Internet is completely secure. Accordingly, we encourage you to take every precaution to protect your personal data when you are on the Internet.

Access to your personal information

You always have a right of access to the information we have about you. To review and update your personal contact information, simply contact our Call Centre using the contact details available on the site. Additionally, you have the right to have any inaccurate information corrected and where applicable, erased.

It is our right to ask you to provide us with a written request for information we hold about you.

Should you not wish to suspend your account but just better control your spending you may choose to place limits on your deposits or bet amounts.

For your benefit you will not be allowed to remove any restrictions placed on your account or bets until a minimum period of seven days has elapsed from when you created the limitation. Should you however, wish to further limit your betting any changes of such kind will be immediately accepted by the system.

BETTING RULES

B. HORSE BETTING

B1. Totalisator Betting

With all horse betting, Primebet offers its customers the possibility to bet on the totalisator odds determined for each racecourse and the different types of bets offered, without influencing the odds determination on each race course. When placing a totalisator bet, Primebet does not guarantee fixed odds, but rather, at the end of the bet-upon race, adopts those odds that the totalisator has determined for that racecourse. Therefore, each type of bet is also subject to the betting rules established by the individual racecourses. One can find information about the permitted types of bets automatically on the Website.

B2. Betting on the Winner (Straight Bet)

Bets on the winner are won if the horse on which the bet has been placed is declared to have finished first according to the official result given by the totalisator/organiser of the race.

At French racecourses a bet on the winner can also be placed as a stable bet. In this case the bet is placed not on a particular horse but rather on a stable and, therefore, on all horses from that stable which start the race.

B3. Place Betting

Place bets are won if the selected horse is declared by the totalisator/event organiser to have placed, as explained below:-

Germany:

1 - 3 Starters: no Place quotas

4 - 6 Starters: two Place quotas

8 or more Starters: three Place quotas

United Kingdom, Ireland, France, South Africa:

1 - 3 Starters: no Place quotas

4 - 7 Starters: 2 Place quotas

8 or more Starters: 3 Place quotas

United Kingdom, Ireland

16+ Starters, handicap races only: 4 Place quotas

For all United Kingdom, Irish, and South African events on offer, a place bet is only possible when connected in a 1:1 ratio with a bet on the winner.

Primebet reserves the right not to offer some Place bets in particular those offered by smaller totalisators/event organiser regardless of whether these types of bets are offered by the respective totalisator.

For Place bets there are no stable bets.

B4. Perfecta/Exacta/Straight Forecast

A Perfecta is won if the two selected horses are declared by the totalisator/event organiser to be the first and second place finishers, and they place in the same order as selected. If a selected horse does not race, the bet is considered invalid and the bet amount is paid back.

If less than two horses reach the finish, all Perfectas are lost.

With Perfectas, there are no stable bets.

B5. Straight Trifecta/Treble Forecast/Tierce/Tricast

A Straight Trifecta is won if the three selected horses are declared by the totalisator/event organiser to be the first, second, and third place finishers, and they place in the same order as selected. If any of the selected horses do not race, the bet is considered invalid and the bid is paid back.(Same as perfecta. If less than three horses reach the finish, all Trifectas are lost. For Trifectas, there are no stable bets.

B6. Stable Bets

Stable bets are bets wherein one does not bet on a particular horse but rather on a particular Stable. These bets are only valid for Bets on the Winner (Straight Bets). Horses in a particular stable are denoted in the betting information according to the following code: E1 (Stable 1), E2 (Stable 2), etc.

B7. Quinella/Reverse Forecast

Quinellas are won if the two selected horses are declared by the totalisator/event organiser to have placed as both first and second regardless of the exact order. If a selected horse does not race, the bet is declared invalid and the bet amount is paid back.

If less than three horses reach the finish, all Quinellas are lost.

For Quinellas, there are no stable bets.

B8. Quinella Box

Quinella Box's are won if the two selected horses are declared by the totalisator/event organiser to have placed as either first and second, first and third, or second and third, regardless of the exact ordering. If a selected horse does not race, the bet is declared invalid and the bid is paid back.

If less than three horses reach the finish, all Quinella Box's are lost.

If less than eight horses start in a race, aell Quinella bets are paid back.

For Quinella Box bets there are no stable bets.

B9. Trifecta Box

A Trifecta Box is won if the three selected horses are declared by the totalisator/event organiser to be the first, second, and third place finishers, regardless of the order in which they place. If any of the selected horses does not race, the bet is considered invalid and the bid is paid back.

If less than three horses reach the finish, all Trifecta Box's are lost.

For Trifecta Box's, there are no stable bets.

B10. Odds Determination

In general, the exact odds are adopted as offered by each totalisator/event organiser for each type of bet, which means they are independent of Fixed Odds bets at the time of placing the bet.

With United Kingdom, Irish, as well as South African events, Primebet takes the final given odds (known as the starting price-SP) which is offered as an independent assessment of all the average bookmaker prices at the racecourse where the event is held.

All odds will be converted and displayed as a ratio to 10.

B11. Special Bets with Primebet

In order to keep the bets as exciting and varied as possible for its customers, Primebet offers a number of types of bets which are not offered by the totalisators/event organisers referred to in this General Terms and Conditions/Rules. Primebet sometimes offers, for example, the so-called "A Primebet Trifecta", which is available on all French and English races for which an official Trifecta/Tierce/Tricast is not available.

B12. Primebet Fixed Odds

Primebet offers exclusive fixed odds for a large number of horse races for which the possible winnings for the customer are taken to be fixed upon placing the bet. Primebet establishes the fixed odds according to a subjective estimation of the results of a race. Primebet may at any time alter these odds for further betting on the grounds of new knowledge and betting offers which have taken place.

A Fixed Bet is considered to be a bet, in which the bet provider has guaranteed the potential return at the time of the completion of the bet and has registered that on the betting slip. The amount the betting customer will be paid, should they win, is therefore clear from the beginning.

The outcome of a bet with Fixed Odds is determined in accordance with the totalisator/event organizer, which means the winner is declared according to the results of the race on which the Totalisator/event organizer makes calculations and payments.

Should bets be paid back or not accepted by the totalisator/event organizer due to technical reasons, the Fixed Odds will retain their value, provided official race results are presented. These results will determine the payout. Horses, which due to race organization could not be bet on, will remain in their placing. Bids on this place will be lost.

Fixed Odds bets contain the risk that they may be lost, if the selected horse does not race, starts without bets, or is unable to start. For annulled races, the bet retains its validity, if the race is held again on the same calendar day. Otherwise, the original bet will be paid back.

With Fixed Odds bets there are no stable bets.

In the case of a tie the fixed odds will be divided accordingly.

The fixed prices are in principle subject to change without notice and may be changed at any time. The winning claim for the relevant bet is taken to be fixed immediately after the completion of the bet.

All odds are shown in a ratio to 10.

B13. Primebet Ita-Bets

Ita Bets are won, if the selected horse is shown to come in second by the totalisator/event organizer, and the starting number of horses is at least four. The Primebet Ita-Bet is offered in all countries and conforms to the specifics regarding different countries discussed below.

The evaluation of an Ita Bet takes the second place odds as its basis:

for 2nd place odds, second place times 2

for 3rd place odds, second place times 2.5

If, in a race, the odds of the perfecta are lower than the odds of the Ita, then the odds of the perfecta are used for Ita Bet.

If less than three horses finish reach the finish, all Ita Bets are lost.

With the Ita Bet there are no stable bets.

For reimbursements of place bets by the totalisator, the Ita bets pending with Primebet will be calculated in accordance the basic place ratio of 10 for 10.

All odds are shown in a ratio to 10.

B14. Primebet Trita-Bets

Trita Bets are won, if the selected horse is shown by the totalisator to place third. The Primebet Trita-Bet is offered in all countries and conforms with the specifics regarding different countries discussed below.

The evaluation of a Trita-Bet takes the third place odds as its basis:

3rd place odds times 2.5

If, in a race, the odds of the straight trifecta are lower than the odds of the Trita, then the odds of the straight trifecta are used for Trita-Bet.

If less than three horses finish reach the finish, all Trita-Bets are lost.

For Trita-Bets, there are no Stable bets.

For reimbursements of place bets by the totalisator, the Trita-Bets pending with Primebet will be calculated in accordance the basic Place ratio of 10 for 10.

All odds are shown in a ratio to 10.

B15. Parlays

A single bet can cover more than one horse from different races (max.8). All chosen horses must attain the predicted outcome for each type of bet, otherwise the bet is lost. As each win occurs, the bet is automatically pushed forward to the next race and the next horse.

When a bet is won, the ratio of each type of played bet serves as the multiplier in order to deduce the winnings. For example, if the first set of odds is 4/6, the second set is 1/2, and the third set is 3/8, then the entry bet is to be multiplied by 4/6 x 1/2 x 3/8.

Non-starters inside a Parlay pay 10:10.

Should a win occur on a Parlay spanning over several race places with different disbursement limits, the lower disbursement limit enters into force.

B16. Combination Parlays

A Combination Parlay is a combination of a number of Parlays into a single bet. The betting customer may decide, which of the possible combinations he selects.

With the selection of, for example, four horses, the customer may decide between six double Parlays, four triple Parlays, and one quadruple Parlay, or any other betting combination.

Example: the following horses are selected:

Horse A, Horse B, Horse C, Horse D

The following combinations are possible:

A - C

B - C

B - D

C - D

In total six double Parlays/bets

In total four triple Parlays/bets

In order to win, each individual parlay must succeed, as described in section B.2.4. If, for example, one horse doesn't place as betted, then all the individual Parlays containing this event are lost. However, all other Parlays retain their validity.

Non-starters inside a Parlay are valued at 10:10.

Should a win occur on a parlay spanning over several places in a race with different disbursement limits, the lower disbursement limit enters into force.

B17. Primebet Trio/Trifecta Box Bets for France

Should there be no official dividend for a correctly selected betting slip then the dividend shall be calculated according to the Primebet formula listed in B.20. (Primebet Tricast-Bets).

The computation of the replacement odds takes the third place odds as its basis. When put together, the place winnings of the third place odds result in the base number:

basic number up to 25 times 6 plus 10 = trifecta box rate

basic number 26-40 times 7 plus 10 = trifecta box rate

basic number 41-50 times 8 plus 10 = trifecta box rate

basic number 51-60 times 15 plus 10 = trifecta box rate

basic number 61-70 times 18 plus 10 = trifecta box rate

basic number 71-80 times 21 plus 10 = trifecta box rate

basic number 81-90 times 24 plus 10 = trifecta box rate

Should the totalisator reimburse the place bets due to special circumstances, the ratio of 11 for 10 will come into effect. The same goes for cases in which the totalisator calculates 10 for 10 on its own.

If less than three horses finish a race, all Trifecta Box bets are lost.

If less than eight horses start in a race, Trifecta Box bets will be paid back, as long as the totalisator has not calculated a Trifecta Box ratio.

For Trifecta Box bets there are no stable bets.

All odds are shown in a ratio to 10.

B18. Primebet Straight Trifecta/Tierce for French Races

Should there be no Straight Trifectas on offer at a French race course, and there are more than seven horses starting, Primebet offers the possibility to bet on the first three horses in the proper order.

The Primebet Straight Trifecta is marked by the Primebet logo behind the type of bet.

The odds of winning are calculated according to the following formula:

Primebet-Tierce-Ratio = (winning odds x 2nd place odds x 3rd place odds) divided by 15.

If a stable horse has won and is the win ratio is smaller than the first place ratio, then 2.5 times the first place odds will be credited as the winner's odds.

If the Primebet Tierce odds are smaller than the Trio odds, then:

Trio-Odds x 1.1 = Primebet Tierce-Odds. - Decimals are to be rounded.

For reimbursements of the winning bets at the totalisator, the Tierce bets pending with Primebet are to be calculated on the basis of 11 for 10 total winning odds of 11.

For reimbursements of place bets at French totalisators, Tierce bets pending with Primebet are to be calculated on the bases of 10 for 10 place odds.

If less than three horses reach the finish, all Tierce bets are lost.

For Tierce bets, there are no Stable bets.

All odds are shown in a ratio to 10.

B19. Primebet Tricast-Bets

Should there be no Straight Trifecta/Tricast bets on offer at the event in a racecourse in England, Ireland, or South Africa, Primebet offers the chance to bet on finishing order of the first three horses. The winnings ratio is calculated according to the following formula:

Primebet Tricast-Ratio =

SP1 x (1: (((1: SP2 ) : (0.1-1 : SP1 )) x ((1: SP3 ) : (0.11 1 : SP1 1: SP2 ))))

SP = Start price

The Primebet straight Trifecta/Tricast bet is marked by the Primebet logo behind the type of bet.

If less than 9 horses start in the race, the Primebet Straight Trifecta/Tricast odds are limited x-times the odds on the perfecta bet, where x is the number of runners. If less than four horses start in a race, all bets will be reimbursed.

For dead heats the stake will be split equally between the different dividends offered by the totalisor/event organiser.

If less than three horses finish, all Primebet Straight Trifecta/Tricast bets are lost.

If a selected horse does not run, the bet amount is returned

All odds are shown in a ratio to 10.

B20. Winnings/Winner Notification/Replacement Odds

The calculations of winnings for a bet are carried out with consideration of the payment and winnings limits for each type of bet and race (B.22). The official results from the totalisator/event organizer are necessary for awarding a winning claim and for the evaluation of the mutually agreed upon odds. The payout of bets is in accordance with the totalisator/event organizer of the relevant racecourse. Special bets offered by Primebet, which are not available through the totalisator, are paid out according to the odds set by Primebet.

Should a type of bet be offered by the totalisator/event organizer, but not be won by any better at the event location/according to the totalisator, Primebet will make payouts for the winning bets, regardless of the other rules of the event organizer, according to the following supplementary odds:

Straight Bet: 250 for 10

Place Bet: 125 for 10

Ita/Trita: 125 for 10

Perfecta: 5,000 for 10

Straight Trifecta: 25,000 for 10

Quinella/Quinella Box: 5,000 for 10

In a dead heat, the supplementary odds will be split respectively.

Primebet will not pay a dividend that is greater than three times the totalisator/event organiser’s dividend.

The winnings are automatically credited to the betting account. In certain cases, crediting of winnings can be withheld until the appearance of the official results.

B21. Limits on Payouts and Winnings

There are limits on winnings for each race per customer as well as, in some cases, limits on winnings for particular types of bets/individual bets per customer and race: Primebet checks the winning limits for each customer and race in the following obligatory sequence:

1. It must check to see if a winning limit or payout amount for a type of bet has been exceeded.

2. It must check to see if one or more winning limits are present for a type of bet, and that the sum of all documented payouts has not exceeded the winning amount guaranteed per customer and race.

The pure payout amount is meant to be the winnings, without any allowance for the entry bid (Brute Winnings). It follows detailed limitations, structured according to the time in the countries where the offer stands and the types of bets.
